A company (NGO) whose main objective is to provide social assistance by promoting commerce, education, research, art, science, sport, religion, charity, etc.
A person or partnership may apply to the Commercial Registry under Section 8 of the Company Deed using the forms required for charitable company registration.
There is no constraint on the payment of compensation to employees/directors of Section 8 companies.
Registration in Section 12A allows the Section 8 corporation to be exempt from tax rates. In contrast, listing in Section 80G exempts the taxable income of the person who donates to the NGO, resulting in more donations.
These entities don’t seem to be engaged in any economic activity rather like mercantilism and commerce in order that they can’t be treated as a rateable person under Goods and Services Tax.
